Is Your Etsy Shop a "Business" Under Florida Law?

The IRS uses a nine-factor test for this determination - but practically speaking, if you are on Etsy consistently, reinvesting in materials and marketing, and tracking your income, you are running a business. Florida law does not have a separate hobby/business test for licensing purposes - if you are receiving compensation for goods or services in Florida, local licensing requirements apply regardless of profit levels.
Florida Business Tax Receipt (the "Business License")
Florida does not have a single statewide business license. Instead, local governments - counties and cities - issue a Business Tax Receipt (BTR), formerly called an "Occupational License." If you are operating a business from a Florida address, even a home-based Etsy store, you likely need a BTR from your county and potentially your city.
- Hillsborough County (Tampa): Home-based businesses require a BTR from Hillsborough County Tax Collector. Fees start around $45 per year depending on business type.
- Pinellas County (St. Petersburg / Clearwater): Pinellas County issues Local Business Tax Receipts. Home-based business fees typically range from $25 to $100 per year.

Florida Sales Tax: Does Etsy Collect for You?
This is the question that trips up most Florida Etsy sellers. The good news: since 2021, Etsy has been a "marketplace facilitator" under Florida law. Under Florida Statute Section 212.05965, marketplace facilitators are required to collect and remit Florida sales tax on behalf of sellers for transactions processed through their platform.
What this means for you: Etsy collects and remits Florida's 6% state sales tax (plus applicable local surtax) on your Florida sales automatically. You do not need to collect Florida sales tax from Etsy customers yourself, and you do not need a Florida Seller's Permit just to sell on Etsy.
However, if you sell through your own website, at craft fairs or markets, or through other platforms that are not marketplace facilitators, you are responsible for collecting and remitting Florida sales tax on those sales yourself. Those channels require a Florida Annual Resale Certificate and registration with the Florida Department of Revenue.

- Liability protection: If a customer claims injury from your product, a slip-and-fall at a craft fair, or a dispute over a custom order escalates, an LLC keeps business liability from reaching your personal savings and property.
- Tax flexibility: Once your Etsy income becomes meaningful, you can elect S-corporation tax treatment for your LLC to reduce self-employment tax on profits above a reasonable salary level.
- Professional credibility: Wholesale buyers, consignment shops, and collaborators take you more seriously as a business entity.
- Separate finances: A dedicated business bank account makes bookkeeping cleaner and simplifies tax time.
Florida LLC formation costs $125 in state filing fees, plus $138.75 per year for the annual report. It takes 3-5 business days with standard processing. If your Etsy store is making more than a few thousand dollars per year, the protection and professionalism of an LLC is worth the cost.
Sunbiz Registration and Fictitious Name (DBA)
If you form a Florida LLC, you will register your business with the Florida Division of Corporations at Sunbiz.org. If your LLC name and your Etsy shop name are different, you will need to register a fictitious name (DBA) with Sunbiz as well. The fictitious name registration fee is $50 and must be renewed every five years.
If you are operating as a sole proprietor (no LLC) under any name other than your legal full name, Florida law requires a fictitious name registration before you use that name in commerce. For example, operating as "Sunshine Stoneware" when your legal name is Jane Smith requires a fictitious name filing.
When to Formalize: A Practical Threshold
- Under $5,000/year in Etsy revenue: At minimum, register the fictitious name if you are using one, and check your county's BTR requirements. An LLC may not be worth the annual report cost at this stage.
- $5,000 to $20,000/year: Strongly consider an LLC. The liability protection alone justifies the $125 formation fee and $138.75 annual report. Open a dedicated business bank account.
- Over $20,000/year: Formalize fully. LLC, business bank account, a consultation with a CPA about whether an S-corp election makes sense, and a solid record-keeping system for income and expenses.
